when he had already been admitted in Capital Hospital, Bhubaneswar and while claiming so, learned counsel for the petitioners submits a copy of the Emergency Card and other medical documents. The case diary is submitted to the Court by Mr. Mohanty, learned ASC for the State and along with the case diary, the statements of the witnesses recorded under Section 180 BNSS are produced. The copy of the medical report of the victim, namely, Pramod Jani is also submitted. The said report reveals that the victim received a linear abrasion and swelling with an opinion that the injury is simple and might have been caused by a hard and blunt object and as such, the injuries are not grievous and in so far as the alleged incident is concerned, petitioner No.2 claims assault to him and hence, treated at the Capital Hospital, Bhubaneswar. Considering the above facts and the dispute between the parties revealed from the F.I.R. i.e. Anneuxre-1 and the counter F.I.R.s lodged against each other, this Court is inclined to direct all of them to surrender before the learned court below for being released with following conditions.

bail bond of Rs.10,000/- (rupees ten thousand) each with one solvent surety for the like amount each with such other conditions imposed as deemed just and proper in the facts and circumstances of the case. It is also directed that the petitioners and in particular, petitioner No.2 shall not commit any mischief involving the informant, while on bail.
