Heard learned counsel for the parties.

The present Writ Petition has been filed by the Petitioner with the following prayer:

“It is, therefore, humbly prayed that this Hon’ble Court may graciously be pleased to issue Rule Nisi calling upon the Opp. Parties to show cause as to whya writ in the nature of mandamus or any other appropriate writ(s) shall not be issued to restrain the Opp. Parties to stop in making the structure for manufacture of products situated over the petitioner’s property situated in khata no.12, plot no.43 of mouza- Podhabahal under Sundargarh Tahasil of Sundargarh without following due process of law and further be pleased to restrain the Tahasildar, Sundargarh/Opp. Party No.3 to demolish the structure over the property where the petitioner is in peaceful possession and on perusal of causes shown if any or in any insufficient causes shown make the said rule absolute may pass such other order/orders as deemed just and proper.”
