Heard learned counsel for the parties.

In this Writ Petition, the Petitioner has challenged the action of the Opposite Parties in taking steps for eviction/demolition of its medicine shop i.e. M/s. Laxmi Pharma situated over Plot No.473, Khata No.255, Ground Floor, at Dumudum, Bhubaneswar without following due process of law.

Learned counsel for the Petitioner submits that the Petitioner is not the owner of the land in question. In order to carry on the business in the said land in question, an agreement was executed

on 13.01.2025 between the owner of the land in question and the Petitioner. He further submits that as the land in question situated within the jurisdiction of the Opposite Party No.3/Bhubaneswar Municipal Corporation, the Petitioner had obtained the licence for running the said shop from the said Authority.

Learned counsel for the Petitioner further contends that the Opposite Parties have taken steps for demolition of the shop of the Petitioner without following any due procedure of law. He further submits that the dispute between the Municipality and the proforma Opposite Party shall be resolve at different forum.

Learned counsel for the BMC submits that the Plot No.473 allotted in favour of the proforma Opposite Party No.1 has been mistakenly identified as Plot No.483 and, accordingly, he has constructed a house over the same and spent money.

Considering the submission made by the parties and the fact that the dispute between the Municipal Authority and the proforma Opposite Party No.1 can be resolved at an appropriate forum, the Petitioner is directed to re-locate his medicine shop to some other place within one month from the date of receipt of a certified copy of this order. In the meantime, the Municipal Authority should issue notice to the proforma Opposite Party No.1 before carry out any eviction notice.
