Heard the learned counsel for the Petitioner and the State.

By means of this application, the Petitioner seeks grant of bail U/s.438 Cr.P.C. in apprehension of arrest for his alleged involvement in the offences U/s. 380/457, IPC in connection with Madhupatna P.S. Case No.405 of 2023 corresponding to G.R. Case No.1340 of 2023 pending in the court of the learned J.M.F.C.-IV (Cog.Taking), Cuttack.

It is alleged in the F.I.R. that the informant had a business of Stabilizer Manufacturing Unit running in a rented house at Netaji Nagar, Cuttack. On 05.12.2023 while all the employees were on leave due to “Prathamastami” festival, some miscreant by breaking open the door of the house has stolen away his Scooty bearing Regd. No.OD-05D-7922, about 30 numbers of Electric Stabilizers, some spare parts and CC TV Camera Hard Disc, etc. from his manufacturing unit house.

The present Petitioner is alleged to be involved in the crime. Considering the nature of the allegations, gravity of the offences and the facts and circumstances of the case, while this court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioner surrenders and moves for bail before the learned J.M.F.C.IV (Cog.Taking), Cuttack in G.R. Case No.1340 of 2023 within a period of three weeks from today, he shall be allowed to go on bail on such terms and conditions as would be deemed just and proper by the said court but subject to verification of criminal antecedents of the Petitioner besides the further condition of depositing cash of Rs.10,000/- (Rupees Ten Thousand) by the Petitioner in the manner as would be directed by the court concerned. The ABLAPL is disposed of accordingly.
