Heard the learned counsel for the Petitioners and the State.

By means of this application, the Petitioners seek grant of bail U/s.438 Cr.P.C. in apprehension of arrest for their alleged involvement in the offences U/s.294/307/323/325/506/34 of IPC in connection with Udala P.S. Case No.419 of 2023 corresponding to C.T. Case No.1161 of 2023 pending in the court of the learned S.D.J.M., Udala.

It is alleged in the F.I.R. that on 23.12.2023 at about 8.56 p.m. the present Petitioners along with other accused persons attacked the Informant and his students inside college campus and further alleged that the accused persons abused him in filthy languages and one of the accused person attacked him to kill by throwing bhujali on his neck but when he bent down got narrowly escaped.

Considering the submission of the learned counsel for the Petitioners, nature of allegations, the circumstances appearing, the seriousness and gravity of the offences, while this Court is not inclined to grant anticipatory bail, it is directed that in the event the Petitioners surrender and move for bail in connection to Udala P.S Case No.419 of 2023 within a period of three weeks hence, they shall be admitted to bail on such terms and conditions as would be deemed just and proper by the said court subject to deposit of Rs.4,000/- (Rupees three thousand) each.

It is made clear that the court shall verify the criminal antecedent in respect to the present Petitioners. In case antecedent is noticed, the order of this Court shall not be given effect to and the court shall be free to deal with matter of bail according to its merit without further reference to the present.

The ABLAPL is disposed of accordingly.
