This matter is taken up through hybrid mode.

This application has been filed for modification of judgment/ order dated 14.12.2023 on the ground that due to unavoidable circumstances, the Petitioner could not submit the representation to the E.S.I. Authority in time as per liberty given by this Court and the order dated 14.12.2023 be modified, granting further two weeks’ time to the Petitioner to submit a fresh application before the Deputy Director (Revenue), ESIC, Bhubaneswar so also allow it to operate the bank account with the Opposite Party No.3-Bank, as observed in paragraph No.14 of the said judgment.

3. In view of the reasons assigned in the application so also submission made by the learned Counsel for

the Petitioner, the Petitioner Establishment is permitted to give a representation in terms of order dated 14.12.2023 within a week hence.

4. It is made clear that on submitting such representation within the extended period, the Authority concerned shall act in terms of observations and directions given vide paragraph Nos.14 & 15 of the judgment dated 14.12.2023 and do the needful.

5. With the said modification/clarification, the I.A. stands disposed of.

6. Urgent certified copy of this order be granted on proper application as per rules.
