This matter is taken up through hybrid mode.

None appears for the Petitioner at the time of call.

This writ petition has been filed assailing the order dated 21^st September, 2011 (Annexure-4) passed by learned Civil Judge (Senior Division), 1^st Court, Cuttack in C.S. No.426 of 2008, whereby an application for stay of the suit under Section 10 CPC, has been rejected.

Letter dated 14^th August, 2023 of 1^st Additional Senior Civil Judge, Cuttack discloses that the suit was posted to 17^th August, 2023 for objection and hearing on the petition dated 30^th January, 2012 filed by the Plaintiff.

Since none appears for the Petitioner to pursue the matter, this writ petition stands dismissed for non-prosecution.

Interim order dated 9^th December, 2011 passed in M.C. No.18339 of 2011 stands vacated.

Since the suit is of the year, 2008, learned trial Court should make all endeavour to see that it is disposed of at an early date. No liberal/long adjournment shall be granted in the suit.
