This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner as well as learned counsel for the State-Opposite Parties.

The present writ petition has been filed by the Petitioner with the following prayers:-

“It is, therefore, humbly prayed that the Hon’ble Court may graciously be pleased to admit the writ petition, issue RULE NISI in the nature of appropriate writ or any other writ (s) as deem fit and proper calling upon the Opp. Parties to show cause, as to why the prayer made hereunder be not allowed, and if no/insufficient cause, the said rule be made absolute by issuing writ(s) in the nature of;

The Opp. Parties be directed for grant of the Grade Pay of Rs.5400/- and Rs.6600/- at the stage of 2^nd & 3^rd RACP w.e.f. 01.01.2013 in accordance with the ORSP Rules, 2008 read with the Finance Department Resolution dt. 06.02.2013 at Annexure-2 taking into account the

order No.49708, dt. 23.12.2022 of the O.P. No.2 at Annexure-6 along with consequential benefits in the interest of justice and the amounts so due may be drawn & disbursed with arrears after re-fixation of his pay to him as a consequential benefit at an early date with all other consequential benefits.

And further be pleased to pass such other writ(s)/order(s) as may deem just and proper.”

It is submitted by learned counsel for the Petitioner that although the Petitioner has filed representation under Annexure-7 before the Opposite Party No.2, but the same is still pending before the said Opposite Party and the said Opposite Party has not taken any decision as of now.

Learned counsel for the State submits that he has no objection, if a direction is given to the authority concerned to consider the representation of the Petitioner in accordance with law within a stipulated period of time.

Considering the submissions made by the respective parties and without expressing any opinion on the merits of the case, this Court disposes of the writ petition at the stage of admission with a direction to the Opposite Party No.2 to consider the representation of the Petitioner under Annexure-7 in accordance with law within a period of two months from the date of production of certified copy of this order. It is needless to mention here that the representation of the Petitioner shall

be considered and disposed of by passing a speaking and reasoned order. Any decision so taken on the said representation shall be communicated to the Petitioner within a period of two weeks thereafter.
