Order dated 15^th April, 2011 (Annexure-9) passed by learned Senior Civil Judge, 1^st Court, Cuttack in C.M.A. No.755 of 2010 (arising out of C.S. No.46 of 2006) is under challenge in this writ petition, whereby an application filed by the Petitioner under Section 151 C.P.C. to repair the house situated over Schedule ‘A’ land, has been dismissed.

Mr. Bhuyan, learned counsel for the Petitioner submits that the suit out of which this writ petition arises has already been disposed of in the meantime. Hence, this writ petition has become infructuous.

Ms. Mohanty, learned counsel for the Opposite Parties also agrees to the said submission.

Accordingly, this writ petition is disposed of as infructuous.
