Heard Mr. Malay Mishra on behalf of Mr. S.S. Rao, learned counsel appearing for the petitioners; Mr. A.K. Mishra, learned Additional Government Advocate appearing for the State-opposite parties and Mr. S. Das, learned counsel appearing for opposite party no.3.

Mr. Malay Mishra, learned counsel appearing for the petitioners contended that the petitioners have filed this writ petition seeking direction to opposite party no.3 to consider and dispose of the letter under Annexure-9 to recall the order as per Annexure-8. He further contended that the petitioners have already complied with the deficiencies pointed out by the

authority and they have clarified it vide Annexure-9. Therefore, the petitioners seek direction to opposite party no.3 to take a decision on the basis of clarification made vide Annexure-9.

In view of limited nature of grievance and without delving into the merits of the case, this Court disposes of the writ petition directing opposite party no.3-State Pollution Control Board, Odisha to take a decision on Annexure-9 filed by the petitioner as expeditiously as possible, preferable within a period of three months from the date of communication/production of this order.
