This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the petitioners.

The Interlocutory Application has been filed for an appropriate direction in a disposed of bail application.

It is submitted by learned counsel for the Petitioners that vide order dated 08.09.2023, this Court directed the Petitioners to surrender and move for bail and in such event, learned Court below was directed to release the Petitioners on bail subject to verification of antecedents of the Petitioners and in the event the Petitioners are having more than two criminal antecedents, then the order dated 08.09.2023 shall not be given effect to.

Learned counsel for the Petitioners further contended that vide order dated 21.09.2023, the learned Court below while considering the criminal antecedent has included the present case.

On a perusal of order dated 21.09.2023, this Court directs J.M.F.C., Aul not to consider the present case as an adding the

antecedents while considering the bail application of the Petitioners. Further, it is made clear that besides the present case which of the Petitioners is having more than two criminal antecedents, then he shall be release on bail as directed vide order dated 08.09.2023.

The I.A. is disposed of accordingly.
