Having heard learned counsel for the parties and after going through the records, it appears that the petitioner was engaged as Data Entry Operator in the office of the District Inspector of Schools, Balasore pursuant to appointment letter dated 19.10.2010. Accordingly, she joined on 22.11.2010. Before joining of the petitioner, one Kumari Bandana Patra was continuing as Data Entry Operator, since she was unauthorizedly absent and despite repeated reminders she did not turn up, the authority decided to engage the petitioner in regular manner in the said post against the existing vacancy. Therefore, from the date of joining, the petitioner was discharging her duty as Data Entry Operator. On 03.01.2011, the District Inspector of Schools addressed a letter to the State Project Director, OPEPA to approve the engagement of the petitioner and to release the remuneration in her favour. Though, the petitioner was continuing, her services were not regularized, she submitted a representation before the authority for regularization of her services. But no step was taken. Subsequently, on the basis of allegations made against the District Inspector of Schools, an enquiry was conducted by the Deputy Director, OPEPA, Auditor, Finance and it was found that the allegations were correct.
