Heard Mr. A. Pattanaik, learned counsel for the petitioner and Mr. P.M. Pattajoshi, learned Standing Counsel for School and Mass Education Department.

The petitioner has filed this writ petition claming B.A. C.P.Ed. scale of pay with effect from 01.04.1991 from the date of acquiring such qualification.

Mr. A. Pattanaik, learned counsel for the petitioner contended that the claim of the petitioner is squarely covered by the judgment of this Court in Niranjan Nayak and another v. State of Orissa and others , 2003(II) OLR 321 which has been confirmed in SLP (Civil) No.9352 of 2004. Therefore, the petitioner may be permitted to file a fresh representation before opposite party no.2 within three weeks which shall be considered in accordance with law, to which, Mr. P.M. Pattajoshi, learned Standing Counsel for School and Mass Education Department has no objection.

Considering the facts and circumstances of this case, without expressing any opinion on the merits of the case, this writ petition stands disposed of with the direction that in case the petitioner, with regard to the grievance made in this petition, files a fresh comprehensive representation before the opposite party no.2 within two weeks, the same shall be considered and decided by the said authority in the light of the ratio decided by this Court in Niranjan Nayak as mentioned supra, as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with the authenticated/certified copy of this order.
