Heard Mr. Subrata Mishra, learned counsel for the Petitioners and Miss Samapika Mishra, learned Addl. Standing Counsel for the State-Opposite Parties.

The grievance of the Petitioners in this writ petition is with regard to inaction of the Secretary, Odagaon Grama Panchayat-Opposite Party No. 9 in considering their application under the provisions of the Scheduled Tribes and other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006 (for short ‘the Act’). In that regard, they have made applications under Annexures-2, 3 & 4, which are stated to be pending before the Opposite Party No. 9. Hence, they have prayed for a direction to consider the same in accordance with law.

Miss Mishra, learned Addl. Standing Counsel for the State submits that she has no instruction in the matter. If such applications are pending before the authority, a direction may be made for early consideration of the same in accordance with law.

Taking into consideration the submissions of learned counsel for the parties, this Court without expressing any opinion on the merits of the case disposes of this writ petition with a direction that the concerned authority before whom the applications filed under Rule 11(6) of the Act as at Annexures2, 3 and 4 are stated to be pending, shall proceed with the matter and take a decision by passing a reasoned order as

expeditiously as possible preferably within a period of six months from the date of production of an authenticated copy of this order, if there is no legal impediment.

As the restrictions due to the COVID-19 situation are continuing, learned counsel for the parties may utilize a soft copy of this order available in the High Court’s website or print out thereof at par with certified copy in the manner prescribed vide Court’s Notice No. 4587 dated 25^th March, 2020.
