Settlement ROR published in the year 1970, the suit land was wrongly recorded only in the name of Banchhu Sethi. Chandramani Sethi, son of Banchhu Sethi ignoring the share of his three sisters, namely, Kamali Sethi, Labani Sethi and Huna Sethi, sold 1/3rd share measuring Ac.0.028 decimal and 3 kadi out of Ac.0.085 decimal from plot No.76 and area measuring Ac.0.028 decimal and 3 kadi from Plot No.77 (for short ‘the case land’) to one Jema Dei, wife of Damei Sahu, who is the mother of the present petitioners by registered sale deed No.354 dated 19.01.1978 (Annexure-4). During consolidation operation land register was prepared in the names of legal heirs of Banchhu Sethi, Gurubari Sahu and Indramani Routray. Accordingly, the purchasers of land from the son of Banchhu Sethi filed objection case to record their names. But, the Consolidation Officer directed to record the name of purchaser, namely Jema Dei in the remark column as unlawful purchaser in respect of the case land. The final R.O.R. (Annexure-1/a) under Section 22(2) of the Act was also published accordingly. Subsequently, successors of Banchhu Sethi, namely, Chandramani Sethi and others filed Consolidation Revision No.567 of 1998 before the Commissioner, Consolidation praying to delete the recording of the name of Jema Dei from the remark column.
