Heard Mr. Swadesh Narayan Rath, learned counsel for the petitioner and Mr. Swayambhu Mishra, learned Additional Standing Counsel for the Stateopposite party nos. 1 to 3.

This writ petition has been filed for a direction to the Sub-Collector, Bolangir for early disposal of Mutation Appeal Case No.9 of 2018.

Mr. Rath, learned counsel for the petitioner submits that the matter is ready for hearing and there is no legal impediment for early disposal of the same. But, the Sub-Collector, Bolangir is not taking any step for early disposal of mutation appeal. Hence, this writ petition has been filed.

Mr. Mishra, learned Additional Standing Counsel for the State, on the other hand, submits that he has no instruction with regard to the status of the aforesaid mutation appeal. If the matter is otherwise ready for hearing, the Sub-Collector, Bolangir should take steps for early disposal of the same in accordance with law, if there is no legal impediment.

Taking into consideration the submissions made by learned counsel for the parties, this Court without expressing any opinion on the merits of the case, disposes of the writ petition with a direction that the Sub-Collector, Bolangir-opposite party no.2 shall do well to consider and dispose of Mutation Appeal Case

No.9 of 2018 on its own merit in accordance with law as expeditiously as possible preferably within a period of four months from the date of production of an authenticated copy of this order downloaded from the website of the Orissa High Court giving opportunity of hearing to the parties concerned, if there no legal impediment.

As the restrictions due to the COVID-19 situation are continuing, learned counsel for the parties may utilize a soft copy of this order available in the High Court’s website or print out thereof at par with certified copy in the manner prescribed, vide Court’s Notice No.4587, dated 25^th March, 2020.
