Against imposition of penalty vide Annexure-11 dated 16.09.2020, the petitioner has approached this Court by filing this writ petition
Mr. A.K. Mohanty-A, learned counsel for the petitioner submitted that the petitioner has already preferred an appeal vide Annexure-12 before the Director, Secondary Education, Odisha and the same may be directed to be disposed of as expeditiously as possible by affording an opportunity of hearing to the petitioner.
Mr. B. Mohanty, learned Standing Counsel for School and Mass Education Department contended that if an appeal is pending, the writ petition is not maintainable.
Having heard learned counsel for the parties, since an appeal is pending vide Annexure-12, this writ petition stands disposed, without expressing any opinion on its merits, with the direction to the appellate authority shall consider and dispose of the appeal by passing a reasoned order and speaking order within a period of six months from the date of production of certified/authenticated copy of this order by the petitioner.
With the above observation and direction, the writ petition stands disposed of.
