25.02.2021 Heard Mr. Dinabandhu Nayak, learned counsel for the petitioner on physical mode and Mr.Dillip Kumar Mishra, learned Additional Government Advocate for the State-opposite parties on virtual mode.

This writ petition has been filed for early disposal of Misc. Case No.6 of 2012, which has been filed for restoration of R.C. No.58 of 2001.

Mr.Nayak, learned counsel for the petitioner submits that although the Misc. Case for restoration of the Revision Petition has been filed since 2012 and endeavour has been made to get it listed, the matter could not be listed even for consideration for issuance of notice to the opposite parties. In course of hearing, he therefore, submits that the matter may be directed to be listed for consideration for issuance of notice to the opposite parties in Misc. Case No.6 of 2012 at an early date.

Mr.Mishra, learned AGA submits that the petitioner may file a memo to the above effect, which can be considered in accordance with law.

Taking into consideration the submissions made by learned counsel for the parties, this Court, without expressing any opinion on merit of the case, i.e., Misc. Case No.6 of 2012 of, disposes of the writ petition with a direction that in the event the petitioner files a memo along with certified copy of this order for listing of the said Misc. Case for consideration, the same shall be

listed for consideration of issuance of notice to opposite parties if the matter is otherwise ready and there is no legal impediment.

Issue urgent certified copy of the order on proper application.
