Mr. Pattanaik, learned counsel for the Petitioners submits that the Petitioners are in possession of the land pertaining to Hal Khata No.490, Hal Plot No.466 to an extent of Ac.0.820 decimals, which corresponds to Sabik Khata No.270, Plot No.496 to an extent of Ac.0.820 decimals in mouza-Patia under Bhubaneswar Tahasil in the district of Khordha (for short, ‘the case land’). It is their case that Sri Sailendra Narayan Bhajdeo inducted Sri Ratnakar Rout as a tenant in the year 1940-41 in respect of the case land. Since then, said Ratnakar Rout and after his death, the Petitioners are in possession over the case land. Recently, on the requisition of the Land Officer, G.A. Department, Government of Odisha, Bhubaneswar, OPP Case No.39 of 2020(L) was initiated against one Sri Dhusa Rout and Smt. Banalata Rout, wife of late Murali Rout, Milu Rout and Silu Rout, sons of late Murali Rout. Since the Petitioners are in possession over the case land, they filed an application to implead them as parties to the case.
