Heard Mr. L.K. Mohanty, learned counsel appearing for the petitioner and Mr. B. Mohanty, learned Standing Counsel for School and Mass Education Department.

The petitioner has filed this writ petition seeking direction to the opposite parties to release block grant/Grant-in-Aid in his favour w.e.f. 01.01.2004 and release all consequential benefits of revision of pay.

Mr. B. Mohanty, learned Standing Counsel for School and Mass Education Department raised preliminary objection with regard to maintainability of the writ petition and contended that if the petitioner seeks for release of block grant/Grant-in-Aid, he should have invoked the jurisdiction of State Education Tribunal, Bhubaneswar. Instead of approaching the State Education Tribunal, Bhubaneswar, the petitioner has approached this Court directly.

Considering the contentions raised by learned counsel for the parties, this Court is not inclined to entertain this writ petition. However, liberty is granted to the petitioner to approach the appropriate forum under Section 24-B of the Orissa Education Act claiming the benefit of block grant in accordance with law.

With the above observation, the writ petition stands disposed of.
