This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

Heard learned counsel for the petitioner and learned Additional Government Advocate for the State.

The grievance of the petitioner is that the Principal-cumSecretary of Gopabandhu Science College, Athagarh- Opposite Party No.3 has forcibly occupied the private land of the petitioner for extension of the College campus.

In this regard, demarcation case is pending before the Tahasildar, Athagarh.

The petitioner has filed a representation vide Annexure-2 series before the Collector, Cuttack- Opposite Party No.5 for redressal of his grievance.

Regard being had to the facts and submissions and the nature of relief sought for, the writ petition is disposed of, directing the Tahasildar, Athagarh- Opposite Party No.7 to treat the representation of the petitioner vide Annexure- 2 series filed before the Collector, Cuttack as one filed before him and he is further directed to dispose of the said representation vide Annexure- 2 series in accordance with law, by passing a reasoned order, within a period of three months from the date of receipt of a certified copy of this Order.

It is needless to mention here that, in course of disposal of the representation vide Annexure- 2 series, the demarcation proceeding shall be concluded in presence of the petitioner and Opposite Party No.3 or his representative and it would be found out whether the Principal-cum-Secretary of the College has encroached the private land of the petitioner.

The petitioner is directed to supply a copy of the writ petition containing all the annexures along with a certified copy of this order to the Opposite Party No.7 for convenience & reference to Annexure-

With the aforesaid observation, the writ petition is disposed of.

Urgent certified copy of this order be granted as per rules.
