The present writ application has been filed with a grievance that the compensation caused by damage of Cyclone ‘FANI’ has not yet been given to the petitioner till date.
In this regard, the letter of the Under Secretary, in the Office of the Special Relief Commissioner, Government of Odisha vide Annexure-5 is important. The Under Secretary has already addressed the letter to the Collector, Cuttack to cause necessary enquiry at the earliest and finalise the matter. The letter has been issued to the Collector, Cuttack since 12.02.2021.
Regard being had to the facts and submissions and the materials on record, the Collector, Cuttack- Opposite Party No.2 is directed to cause an enquiry on the basis of Annexure- 5 and find out whether the petitioner is entitled to get any compensation and the matter be disposed of by completing the enquiry within a period of three months from the date of receipt of a certified copy or true soft copy of this Order available in the Orissa High Court website.
It is needless to mention here that, the enquiry shall be conducted by the Collector, Cuttack himself or any Officer subordinate to him.
The petitioner is directed to supply a copy of the writ application containing all the Annexures to the Collector, Cuttack for convenience and reference to Annexure- 5.
The writ application is accordingly disposed of.
As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court’s Notice No.4587 dated 25th March, 2020 as modified by Court’s Notice No.4798 dated 15th April, 2021.
