Since both the MATAs arise out of the judgment and order dated 26.09.2014 passed by the learned Judge, Family Court, Bhubaneswar in Civil Proceeding No.139 of 2012, both the matters are taken up together for disposal. Vide the impugned judgment and order dated 26.09.2014, the learned Judge, Family Court, Bhubaneswar had allowed the application of the Petitioner-Dipalisa Sahu and passed a decree of divorce dissolving the marriage between the parties and directed the husband- Rakesh Kumar Sahoo to pay Rs.20,000/- per month towards alimony to the Petitioner-Dipalisa Sahu till she got remarried along with litigation expenses of Rs.10,000/-.

The parties are present along with their respective counsels through Video Conferencing.

MATA No.121 of 2014 has been initiated by the husband (Rakesh Kumar Sahoo), who was the Respondent/ Opposite Party in Civil Proceeding No.139 of 2012 praying for setting aside the aforesaid impugned judgment and order and MATA No.124 of 2014 has been filed by the wife (Dipalisa Sahu), who was the Petitioner in the said proceeding, praying for enhancement of permanent alimony to more than Rs.25.00 lakhs.

In MATA No.121 of 2014, both the husband and the wife have filed their respective Affidavits with a prayer to pass a decree of divorce by dissolving the marriage solemnized between them on 27.01.2008 in terms and conditions and the averments made in the affidavits and the joint Petition itself and also to dispose of MATA Nos.121 and 124 of 2014.

The parties unequivocally express that they have compromised their dispute and filed their respective Affidavits for dissolving the marriage solemnized on 27.01.2008 between them. In pursuance of the compromise, the husband and the wife have agreed to settle the permanent alimony at Rs.18,00,000/- (Rupees Eighteen Lakhs only) which has already been paid to the wife by the husband. To that effect the parties have also filed a joint Petition along with their respective affidavits.

In that view of the matter, both the MATAs are disposed of confirming the decree of dissolution of marriage passed by the learned Judge, Family Court, Bhubaneswar in Civil Proceeding No.139 of 2012. The averments in the affidavits and the joint petition filed by the husband and the wife containing the terms and conditions shall form a part of this order.

Accordingly, both the MATAs are disposed of. 10. There shall be no orders as to costs. 11. Urgent certified copy of this order be granted on proper
