Perused the report dated 05.02.2021 of the I.I.C., Polasara Police Station.
It is stated in the said report that during enquiry in the locality of village Malatentulia, it is ascertained that the sole appellant, namely, Jaya @ Jayaram Naik, S/O: Late Uchhab Naik of village:Malatentulia, P.S.Polasara in the district of Ganjam has expired about five years back. To that effect also, the report of the Sarpanch of Malatentulia Gram Panchayat has also been annexed.
In view of the death of the sole appellant and the fact that none of the near relatives of the appellant have come forward to continue the appeal, the appeal abates as a whole and stands disposed of as such.
The T.C.R., if any, be sent back forthwith.
