According to Mr. A. Pattanaik, on completion of investigation, while filing final report No.326 dated 12.12.2020 before the learned District & Sessions Judge, Khurda at Bhubaneswar in T.R. No.255 of 2020 arising out of Balianta P.S. Case No.125 dated 30.06.2020, the I.O. has placed reliance on the statements of Sukanta Behera, S/o Panu Behera and Bharat Nayak, S/o Badal Nayak of village Sarakana Ranapur, P.S: Balianta in the district of Khurda though no such persons are available in the above noted address. Therefore, he submits that the opposite parties be directed to initiate appropriate proceeding/ disciplinary proceeding against the I.O. During course of hearing, Mr. A. Pattanaik submits that liberty may be granted to the petitioner to move the Commissioner of Police, Cuttack & Bhubaneswar (opposite party No.3) in the matter and he be directed to take a decision on such motion.
Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioner to approach the Commissioner of Police, Cuttack & Bhubaneswar (opposite party No.3) by filing a comprehensive representation within a period of two weeks from today through registered post. In the event, such representation is filed along with a copy of

this order, the opposite party No.3 is directed to take a decision on the same in accordance with law and communicate the result of such exercise to the petitioner.
Accordingly, this CRLMP is disposed of. Parties may utilize the soft copy of this order available in the High Court’s Website or print out thereof at par with certified copy in the manner prescribed, vide Court’s Notice No.4587 dated 25.03.2020 read with Notice No.4798 dated 15.04.2021.
