We have perused the report submitted by the Senior Superintendent, Circle Jail, Choudwar.
The report reveals as follows:
“….one male life convict namely Guna Mohapatra, S/O:Lt.Kelu Mohapatra was received on transfer from Special Jail, Bhubaneswar on 23.07.2011 on medical ground. After his admission into this jail, he was shifted to SCB Medical College & Hospital, Cuttack several times for check-up & treatment. On 07.08.2011, due to deterioration of health condition, he was shifted to SCB Medical College & Hospital, Cuttack for check-up & treatment and while undergoing treatment, at casualty department of SCB Medical College & Hospital, Cuttack, the above convict namely Guna Mohapatra had died on 7.8.2011 at about 10.10 P.M.”
It is also revealed from the record that none of the relatives/legal heirs of the appellant/petitioner has come forward to this Court to continue this case.

Hence, the appeal stands abated against the appellant/petitioner-Gunanidhi @ Gunamali Mahapatra and is disposed of as such.
