Heard Mr. Satya Narayan Mishra, learned counsel for the Petitioner and Mr. P.K. Maharaj, learned Addl. Standing Counsel for the State.

This is an application under Section 438 Cr.P.C. for grant of anticipatory bail to the Petitioner.

The Petitioner has been implicated for commission of offence under Sections 341/323/294/506/353/34 of the I.P.C. read with Section 11(1)(a) of the Prevention of Cruelty to Animals Act, 1990 in connection with Bhadrak Rural P.S. Case No. 173 of 2021 corresponding to G.R. Case No. 1006 of 2021 pending in the court of learned S.D.J.M., Bhadrak.

Mr. Mishra, learned counsel for the Petitioner submits that the present Petitioner is similar footing like that of coaccused persons in connection with the aforesaid case, who have been directed to be released on bail by this Court in ABLAPL No. 3175 of 2021 vide order dated 25^th March, 2021. He, therefore, prays to release the Petitioner on bail.

Taking into consideration the nature of allegation made and the fact that the co-accused persons have been released on bail by this Court in BLAPL No. 3175 of 2021, this Court is not inclined to grant anticipatory bail to the Petitioner. However, it is directed that in the event the Petitioner surrenders before learned S.D.J.M., Bhadrak in

connection with Bhadrak Rural P.S. Case No. 173 of 2021 corresponding to G.R. Case No. 1006 of 2021 and moves an application for bail within a period of two weeks hence, he shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper.

Accordingly, the ABLAPL is disposed of.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court’s website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court’s Notice No. 4587 dated 25^th March, 2020 as modified by Court’s Notice No. 4798 dated 15^th April, 2021.
