Heard learned counsel for the petitioners and learned Addl. Government Advocate for the State.

Petitioners in this writ petition seek for a direction to opposite party No.4-Executive Engineer, Mahanadi Barrage Division, Department of Water Resources, Government of Odisha, Cuttack to take a decision on the representation of the petitioners under Annexure-5 series within a stipulated time.

The grievance of the petitioners is that petitioners have filed an application before opposite party No.4 on 27.11.2017 as they have purchased a plot and file an application for approval of the plan. However the authority has issued a letter to opposite party No.5-Deputy Executive Engineer, Naraj Barrage, Sub-Division, Cuttack for issuance of N.O.C. for construction of S+3 storied commercial building over Plot No. 80 and 83 in Mouza-Unit2, Baimundi Nagar, Cuttacck i.e. a clarification sought for by the Planning Member of Cuttack Development Authority as a piece of land belongs to the Irrigation Department which is used as approaching to the said plot and whether the said plot can be utilized as a whole or not. However, the opposite party No.5 has not yet given any reply to the said query made by the Cuttack Development Authority and the petitioners’ application is still pending. Hence the present writ petition.

In view of the above as the petitioners

application is of the year 2017 and the query made by opposite party No.3 since March, 2018, we dispose of the writ petition without going into the merits of the case by directing opposite party No.4 to dispose of the application of the petitioners within a period of six weeks from the date of production of a copy of the order.
