Heard learned counsel for the parties.
This writ petition involves the following prayer :-
“Under the circumstances, it is therefore humbly prayed that your Lordship may graciously be pleased to issue a Writ in the nature of Mandamus or any other appropriate Writ or Writs directing the Opposite Parties to absorb/induct the petitioners in the cadre of LT in pursuance of new Recruitment Rules, 2019 under Annexure-3;
And further be pleased to regularise the services of the petitioners with effect from the date when the similarly situated persons those who have been absorbed as Senior TB Laboratory Supervisor by the other CDMOs;
And also further be pleased to grant consequential service benefits in favour of the petitioners forthwith;
And pass such other order/orders as this Hon’ble Court deems fit and proper for the interest of justice…”
Filing an additional affidavit, O.P.1 in paragraph-5 stated as follows :-
“5. That in the meantime, the Opposite Parties have taken a decision to consider the cases of Senior TB Laboratory Supervisors (STLS) for their inductions/regularization into the regular health care in the cadre of Laboratory Technicians. Accordingly, the CDM & PHOs and the Superintendents of all the Medical Colleges and Hospitals have been requested to submit the required information along with the supportive documents vide letter No.21702 dated 25.09.2020.
Copy of the letter No.21702 dated 25.09.2020 is annexed and marked as AnnexureA/2.”
In such view of the matter and for the undertaking of the O.P.1 to consider the case of the

petitioner, this Court finds, nothing survives to be decided in this writ petition, which is accordingly disposed of. This Court hopes and trusts that the State will be abided by its undertaking. Interim order, if any, passed earlier shall stands vacated.
The petitioner may utilise the soft copy of this order available in the High Court’s website or print out thereof at par with certified copy in the manner prescribed, vide Court’s Notification No.4587 dated 25.3.2020.
