Heard learned counsel for the petitioners and learned Additional Government Advocate for the State.

The petitioners in this writ petition are the students of 3^rd year of Bachelor of Physiotherapy (B.P.T) Course of 201718 batch of Neelachala Institute Medical Science, Kharabela Nagar (OCHC) Complex, Bhubaneswar. While the petitioners were prosecuting their studies, the Controller of Examinations, Utkal University, Vani Vihar-opposite party no.5 issued a notification bearing No.Ex-I/449/E-7434/2020 dated 04.09.2020 for conduct of 5^th Semester Examination of Bachelor of Physiotherapy (B.P.T) course of March, 2020 of 3^rd year students on 24.09.2020 in physical mode in various colleges. The petitioners challenge such conduct of examination in physical mode due to the prevailing COVID-19 Pandemic on the ground that social distance cannot be maintained and the safety and health of such students will be affected. According to them since the Nursing Students were exempted from appearing in physical mode, the opposite parties may be directed to conduct the examination of the petitioners through “online” mode.

Recently examinations like JEE Main and NEET were conducted throughout the country in physical mode smoothly as per the guidelines of COVID-19. Both the examining bodies as well as the State Government have taken adequate measures to see that such examinations are being conducted smoothly during the pandemic situation as per the guidelines.

In view of the above, we are not inclined to entertain

the writ petition. It is open to the examining bodies/ authorities to proceed as per the guidelines of COVID-19, look into the situation of the locality and take adequate measures for conduct of smooth examination, after consultation with the local administration.

The writ petition is accordingly disposed of.

As the lock down period is continuing for COVID-19, the petitioners may utilize the soft copy of this order available in the High Court’s website or print thereof at par with the certified copy in the manner prescribed, vide Court’s notice No.4587, dated 25.03.2020.
