as per the survey report prepared by the BMC. But after the completion of the construction of the kiosks the same was not allotted to the petitioners for their rehabilitation, for which the petitioner approached the Commissioner, BMC by filing a representation with a prayer to allot the said kiosk. As no action was taken by the Commissioner, BMC, the petitioners approached this Hon’ble Court in W.P.(C) No.20491 of 2019 with a prayer to direct the commission, BMC to consider the case for allotment of the kiosk in their favour wherein this Court had passed order on dated 19.11.2019 with a direction that the petitioners shall file a representation before the authority ventilating their grievance and the authority shall consider the same within a period of three months. In spite of directions of this Court, the Commissioner without considering the representation of the petitioners allotted the kiosk to the outsiders which is under challenge in this writ petition though the petitioners were issued token for getting allotment of kiosk under the Street Venders Protection of Livelihood and Regulation of Street Vending Act, 2014. Ventilating the aforesaid grievance, the petitioners have filed a representation before Opposite Party No.3 on 22.11.2019 vide Annexure-3 and the same is still pending. Hence, the present writ petition.
