In view of extraordinary situation arose out of COVID19 lockdown, the matter is taken up through video conferencing.

Heard learned counsel for the petitioner and learned Addl. Govt. Advocate.

In this writ petition, the petitioner seeks direction to the opposite party no.3 to refer the case bearing P.R. No.943 dated 01.07.2020 pending in the office of the Land Acquisition Officer, Sambalpur to the appropriate court for enhancement of the compensation towards acquisition of his land in respect of M.S. Khata No.278/263, Plot No.2222/ 3096, Mouza-Jujumura under Jujumora Police Station in the district of Sambalpur.

Learned counsel for the petitioner submits that the petitioner has filed a representation to the opposite party no.3the Special Land Acquisition Officer, NH 42(55) Sambalpur vide Annexure-4 ventilating his grievances which is still pending.

But here in this case, as per Section 3-G of the National Highways Act the opposite party no.2-Collector-cumDistrict Magistrate, Sambalpur is the competent authority/arbitrator.

Considering the submission made and in view of the provision of Section 3-G of the National Highways Act, we dispose of this writ petition with an observation that in case the petitioner approaches to the Collector-cum-District Magistrate, SambalpurO.P.No.2 by filing a fresh representation within a period of two weeks, in such event, the said opposite party shall take a decision in accordance with law within a period of four weeks thereafter.

As Lock-down period is continuing for COVID-19, learned counsel for the petitioner may utilize the soft copy of this order available in the High Court’s website or print out thereof at par with certified copies in the manner prescribed, vide Court’s Notice No.4587 dated 25.3.2020.
