Mr. Girija Prasad Dutta, learned counsel for the appellant-Insurance Company and Mr. K.C. Nayak, learned counsel for the respondent nos.1 to 4 are present.
A memo of settlement arrived at between both the parties has been filed in Court, which is taken on record.
In view of the memo of settlement, it is agreed to by the parties that a consolidated amount of Rs.12,53,000/- (Rupees twelve lakh fifty three thousand) only as compensation would be just and proper. Accordingly, the amount of compensation is modified to a consolidated amount of Rs.12,53,000/- (Rupees twelve lakh fifty three thousand) only, which shall be deposited by the appellant-Insurance Company before learned Tribunal within a period of eight weeks hence. On such deposit being made, the said amount shall be disbursed in favour of the claimants-respondents proportionately on proper identification in terms of the impugned award.
The statutory deposit of Rs.25,000/- made before this Court shall be refunded to the appellant-Insurance Company along with interest accrued thereon on furnishing a certificate showing deposit of the aforesaid amount, as directed, before learned Tribunal.
With the aforesaid modification of the impugned award, the MACA is accordingly disposed of.
