This matter is taken up in the National Lok Adalat through virtual mode.
Both the appeals are filed by the Claimants and Insurance Company for enhancement/reduction of the award respectively.
Heard learned counsel for the Insurance Company and learned counsel for the claimants in both the appeals.
A memo of settlement arrived at between both the parties has been filed in Court, which is taken on record.
In view of the memo of settlement, it is agreed upon by the parties that a consolidated amount of Rs.11,50,000/- only as compensation would be just and proper and shall be payable by the Insurance Company to the claimants. Accordingly, the impugned award is modified to a consolidated amount of Rs.11,50,000/- (Rupees eleven lakh fifty thousand) only, which shall be deposited by the Insurance Company before learned Tribunal within a period of eight weeks hence. On such deposit being made, the said amount shall be disbursed in favour of the claimants proportionately on proper identification as per the direction given in the impugned award.
As the settlement is arrived at before the Lok Adalat, no court fee shall be levied on the claimants. With the aforesaid modification of the impugned award, the MACAs are accordingly disposed of.
Authenticated copy of this order downloaded from the website of this Court shall be treated at par with certified copy in the manner prescribed in this Court’s Notice No.4587 dated 25.03.2020.
