- 11.12.2020 This matter is taken up through video conferencing mode because of COVID-19 pandemic.
None appears for the appellant when the matter is called.
Perused the letter bearing No.12243 dated 06.11.2020 issued by the Senior Superintendent Circle Jail, Cuttack atChoudwar.
It is borne out from the letter that the sole appellantSaheb Munda upon being convicted, had undergone life imprisonment and released on Furlough leave from the Jail Custody of Circle Jail, Cuttack at-Choudwar on 31.03.2009 but after a period of five days the convict did not return to the jail. It was ascertained from his family members that the appellant- Saheb Munda died on 06.04.2009.
Since nobody is coming forward on behalf of the appellant to be substituted, the appeal abates.
Accordingly the appeal is disposed of.
LCRs be returned to the lower court forthwith.
