Mr. Haripad Mohanty learned advocate appearing on behalf of Mr. Saktidhar Das learned Senior Counsel for the appellant and Ms. S. Pattnaik the learned Additional Government Advocate for the State are present.
Perused the report of the OIC, Harbhanga P.S., DistrictBoudh wherein he has reported that the sole appellant, Mahadeb Majhi, S/o- Late Mohan Majhi of Village-Geredisahi, P.S. Harabhanga, District-Boudh has died about six years back due to old age and sickness. None of his legal heirs have come forward to be impleaded as parties to proceed with the appeal. Hence, the appeal abates as a whole.
Accordingly, the appeal is disposed of.
As restrictions are continuing due to COVID-19 pandemic, learned counsel for the petitioner/appellant may utilize the soft copy of this order available in the High Court’s official website or print out thereof at par with certified copies in the manner prescribed, vide Court’s Notice No.4587 dated 25.03.2020.
