What the court decided
CRLA No.242 of 2006
- 10.12.2020 This matter is taken up through Video Conferencing mode because of COVID-19 pandemic.
Heard Ms. Saswata Pattnaik, learned Addl. Government Advocate for the State.
Ms. Pattnaik, learned Addl. Government Advocate submits that in the meantime the sole appellant-Sabara Mallik has been released prematurely. Hence, the appeal may be disposed of.
We have also seen the letter addressed to the Director General of Police, Odisha by the Senior Superintendent of Circle Jail, Cuttack at Choudwar which reveals that Sabara Mallik, S/o. Late Ranka Mallik, appellant in CRLA No. 242 of 2006 has since been released on 08.07.2020 as per Memo No.10908 from the prisons.
None appears for the appellant to argue the case probably because the appellant-Sabara Mallik has already been released prematurely in this case.
Accordingly, the Criminal Appeal is disposed of.
The LCR be returned back to the learned Trial Court immediately.
As restrictions are continuing due to COVID-19 pandemic, learned counsel for the appellant/petitioner may utilize the soft copy of this order available in the High Court’s official website or print out thereof at par with certified copies in the manner prescribed, vide Court’s Notice No.4587 dated 25.03.2020.
