Heard learned counsel for the petitioner and learned counsel for the State.
It is submitted on behalf of the petitioner that the petitioner was earlier released on bail on 6.12.2019 in G.R. Case No.993/2019 pending on the file of learned S.D.J.M., Jagatsinghpur for alleged offences under Secs.450/395, I.P.C. and Secs.25/27 of the Arms Act and subsequently due to his non-appearance before the court below, for the reason of communication gap with his lawyer, the NBW of arrest was issued against him by order dated 29.1.2020.
Thus considering the limited nature of prayer and after hearing learned counsel for the State, the CRLMC is disposed of with a direction that in the event the petitioner surrenders on or before 02.12.2020 before the learned court below, he be released on bail in the aforesaid case on such terms and conditions to be fixed by the learned court below in seisin over the matter.
The CRLMC is disposed of.
