The defect be ignored. Learned counsel for the petitioner prays to withdraw the criminal misc. case with liberty to surrender before the concerned court. Accordingly, the CRLMC is disposed of as withdrawn. However, as prayed for by learned counsel for the petitioner, the petitioner is at liberty to surrender before the learned court below and move for bail. In such event, if the petitioner surrenders before the learned S.D.J.M., Talcher in connection with Colliery P.S. Case No.86/2019 corresponding to G.R. Case No.331/2019 within a period of fifteen days from today and moves for bail, the same shall be considered by the learned court below in accordance with law on the same day including the ground of parity, if any found applicable.
