Perused the report submitted by the learned Sessions Judge, Deogarh which is annexed with the letter of the I.I.C. Deogarh. The I.I.C. Deogarh has reported that the sole appellant-Sartika Balua, S/o. Late Late Kuhura Balua of village-Bukabeda, PS/District. Deogarh has expired in the year, 2011. Such information is supported by the written document signed by the widow of the sole appellant which has been signed by the two attesting witnesses.
Keeping in view the death of the sole appellant, the appeal stands abated as a whole against the appellant as none of his legal heirs are coming forward to be impleaded in his place to pursue the appeal.
Accordingly, the Criminal Appeal is disposed of.
The L.C.R be returned back to the learned Trial Court immediately.
