Heard Mr. L.N. Rayatsingh, learned counsel for the petitioner and Mr. S.S. Kanungo, learned Addl. Government Advocate for the State-opp. party no.1.

The grievance of the petitioner in this writ petition is with regard to early disposal of C.S. No. 74 of 2015 pending before learned Civil Judge (Senior Division), Rourkela within a stipulated period.

This Court vide order dated 24.11.2020 directed the petitioner as well as learned counsel for the State to take instruction with regard to the stage of C.S. No. 74 of 2015 pending before learned Civil Judge (Senior Division), Rourkela.

On instruction, Mr. Rayatsingh, learned counsel for the petitioner submits that after filing of the written statements by the defendants, the suit is not proceeding.

Taking into consideration the submission of learned counsel for the petitioner and on perusal of the materials available on record, it appears that the suit is not ready for hearing. Thus, it will not be proper to direct for early disposal of the suit by a particular date. However, it is directed that on filing a petition by the petitioner for early disposal of the suit, learned Civil Judge (Senior Division), Rourkela shall do

well to proceed with the matter expeditiously and make an endeavour for early disposal of the suit in accordance with law. It is further directed that parties shall cooperate with learned Civil Judge for early disposal of the suit. Needless to say that learned Civil Judge will be free to take action as per law, if any of the parties to the suit does not cooperate for early disposal of the suit.

With the aforesaid observation and direction, this CMP is disposed of.
