Heard learned counsel for the petitioner and Mr. S.N. Mishra, learned Additional Government Advocate for the State-opposite parties. 3. The petitioner in this writ petition assails the order dated 15.07.2013 (Annexure-7) passed by the opposite party no.5-Assistant Settlement Officer, Rental Colony, Bhubaneswar in Objection Case No.7525/3469 of 2013, whereby he rejected the claim of the petitioner to record Khata No.1974, Plot No.5930 corresponding to Sabik Khata No.2708/5024, Plot No.2708/2985 (part) in MouzaAndharua, P.S. Chandaka under Bhubaneswar Tahasil in the district of Khurda. 4. Mr. Mishra, learned Additional Government Advocate for the State submits that in the meantime final Record of Right under Section 12-B of the Orissa Survey & Settlement Act, 1958 (for short ‘the Act’) has been published in respect of Andharua Mouza in the month of November, 2013. Thus, the petitioner can approach the Commissioner of Land Reforms and Settlement, Odisha, Cuttack under Section 15(b) of the Act for redressal of his grievances.

Learned counsel for the petitioner, therefore, submits that the petitioner may be permitted to withdraw the writ petition with liberty to approach the Commissioner of Land Reforms and Settlement,

Taking into consideration the prayer made by the petitioner, this writ petition is disposed of as withdrawn granting liberty to the petitioner to move the Commissioner of Land Reforms and Settlement, Odisha, Cuttack under Section 15(b) of the Act.

In the event the petitioner files a revision petition under Section 15(b) of the Act before the Commissioner of Land Reforms and Settlement, Odisha, Cuttack within a period of one month hence, it shall do well to consider and dispose of the same on its own merit in accordance with law.

It is made clear that this Court has not expressed any opinion on the merits of the case.
