This application under Section 439 Cr.P.C. has been made on 19.2.2020 by the petitioner, namely Sahjaad Ali @ Monu, implicated in Bisra P.S. Case No.126 of 2019, corresponding to G.R. Case No.993 of 2019 of the court of learned JMFC(R), Rourkela for commission of offence U/ss.376/420/468/471 of the Indian Penal Code.

Heard learned counsel for the petitioner and the learned Addl. Sanding Counsel.

In view of extra-ordinary situation arose out of COVID-19 Lockdown, the matter is taken up through video conferencing.

Perused the complaint petition which was sent under section 156(3) Cr.P.C. It is mentioned therein categorically that the victim has married the accused and to that extent the copy of marriage certificate issued by Government of Odisha M & BCW Department is filed. Both parties are Mohammadan and the accused – petitioner is in custody since 13.1.2020.

It is stated by learned counsel for the petitioner that charge-sheet has already been filed and after commitment the case is pending before the learned ADJ, Rourkela vide S.T. No.38 of 2020.

Having regards to the nature of accusation, period of detention as well as above attenuating circumstances, I am inclined to grant bail to the present petitioner.

Hence, it is ordered that the petitioner - Sahjaad Ali @ Monu be released on bail on furnishing bail bond of Rs.25,000/-(Rupees twenty-five thousand) with one surety for the like amount to the satisfaction of learned court in sesin over the matter in the above noted case, subject to such terms and conditions as deemed just and proper.
