Heard learned counsel for the petitioner and learned Additional Government Advocate.
In this case prayer has been made to quash the order dated 4.3.2020 passed by the learned S.D.J.M., Rayagada in Rayagada P.S. Case No.258 of 2019 corresponding to G.R. Case No.496 of 2019.
It is submitted by the learned counsel for the petitioner that the accused – petitioner was released on bail on 18.2.2020 by the S.D.J.M., Rayagada. On 4.3.2020 when the accused was found absent on repeated calls and no step was taken, NBW was issued against the accused. He further submits that the petitioner is now ready to surrender, hence appropriate direction may be issued for recall of the NBW.
Having heard learned counsel for the petitioner, the accused – petitioner is directed to appear in the court of learned SDJM, Rayagada within fifteen days from today and in such event she shall be released on bail in Rayagada P.S. Case No.258 of 2019 corresponding to G.R. Case No.496 of 2019 on such other terms and conditions as deemed just and proper and thereafter NBW shall be recalled.
With this observation the CRLMC stands disposed of.
