ABLAPL No. 6331 of 2020
The petitioner is allegedly involved in connection with Khariar P.S. Case No. 34 of 2020 corresponding to C.T.Case No. 34 of 2020, pending before the learned J.M.F.C., Khariar for alleged commission of offence under Sections 394/450 of I.P.C.
Learned counsel for the petitioner contended that some of the co-accused persons have already released on bail.
Perused the F.I.R. Taking into consideration the nature of allegations made against the petitioner, this Court directs that in case the petitioner surrenders before the learned J.M.F.C., Khariar and move an application for bail, the learned J.M.F.C. shall dispose of the same in the first hour of the day. In case of rejection of the bail application of the petitioner, he may move for bail before the next higher forum in the second hour of the day and in that event, the bail application of the petitioner shall be disposed of by the higher forum in accordance with law. Records shall be transmitted to the court below at the cost of the petitioner.
The ABLAPL is accordingly disposed of.
