Heard Mr. S.K. Dash, learned counsel for the petitioner and Mr. A.K. Mishra, learned Addl. Government Advocate.

The petitioner has filed this application claiming U.G.C. scale of pay.

Mr. S.K. Dash, learned counsel for the petitioner contended that this question has already been considered by this Court in the case of Alok Mishra v. State of Orissa (W.P.(C) No.16917 of 2017, disposed of on 28.08.2019). Therefore, this writ petition may be disposed of in the light of the order passed in the aforesaid case.

Mr. A.K. Mishra, learned Addl. Government Advocate contended that since the petitioner claims U.G.C. scale of pay, the same has to be considered on the basis of the judgment rendered by the apex Court in the case of State of Orissa v. Mamata Mohanty , 112 (2011) CLT 46, and, as such, the judgment which has been referred to by learned counsel for the petitioner has also been decided in terms of this case.

Considering the contention raised by learned counsel for the parties and after going through the records, since the petitioner claims for U.G.C. scale of pay, this writ petition stands disposed of in terms of the order passed by this Court in Alok Mishra mentioned supra. The opposite parties are directed to give the

benefit of revised scale of pay to the petitioner with effect from the date of approval of her service and grant her arrear salary with 7% interest per annum within a period of four months from the date of production/communication of certified copy of this order.
