Heard learned counsel for the petitioners and Mr. P.V. Balakrishna, learned counsel appearing for the Opposite Party No.1 & learned counsel for the Opposite Parties 2 & 3.

The petitioners are daughters of Late Sachindra Nath Dalai, whose mother and brother are Sarada Dalai and Prasanta Kumar Dalai, Opposite Parties 3 & 2 respectively. One daughter of aforesaid Sachindra Nath Dalai named Prabhabati Pal has expired in the meantime.

The aforesaid Sachindra Nath Dalai had Rs.61,54,746.00 (Rupees Sixty one lakhs Fifty four thousand Seven hundred Forty six) in different Savings Bank Accounts of Badambadi Branch of State Bank of India.

Schedule- A to the I.A. is details of accounts and deposits in the Account in the name of Sachindra Nath Dalai.

In course of pendency of the writ application, all the parties have come to composition to share the deposits of aforesaid Sachindra Nath Dalai in accordance with the division of amount as

shown in Schedule- B to the I.A. All the parties including the legal heirs of Late Prabhabati Pal have been given Rs.7,31,843/- (Rupees Seven lakhs Thirty one thousand Eight hundred forty three) each and Prasanta Kumar Dalai- Opposite Party No.2 has been given Rs.10,31,843/- (Rupees Ten lakhs Thirty one thousand Eight hundred forty three) as per ScheduleB. As the parties have come to a composition and have filed the aforesaid I.A. for disposal of the writ application on the basis of composition as shown in Schedule- B to the I.A., the writ application is disposed of, directing the concerned Branch of the State Bank of India to disburse the amount in accordance with Schedule-B of the I.A.in favour of each of the legal heirs including the petitioners, Opposite Parties 2, 3 & the legal heirs of Late Prabhabati Pal.

The pendent lite interest accrued on the deposit be credited in favour of Prasanta Kumar Dalai- Opposite Party No.2.

With the aforesaid direction, the I.A. is disposed of.
