Heard Mr. J.K. Rath, learned Senior Counsel appearing along with Mr. D.N.Rath, learned counsel for the petitioner.

The petitioner files this writ application to quash order dated 26.08.2004 passed by the Registrar, Utkal University, Vanivihar in Annexure-3, by which provisional affiliation has been granted to the petitioner college subject to fulfillment of certain conditions which read thus:-

“1. The College has inadequate land as per land requirement norms of the University. In the Urban area the college should have acres 2.00 of land with undisputed ownership and possession of land and this issue will be completed within three months from the date of this Notification.”

When the matter was listed on 25.04.2019, this Court

passed the following order:-

“Since this an old matter of the year 2004, Mr. J.K. Rath, learned Senior Counsel appearing for the petitioner submits that he has no instruction in the matter. Therefore, he seeks time to obtain instruction in the matter regarding status of the relief claimed in the writ application.”

In compliance of the said order, Mr. J.K. Rath, learned Senior Counsel files an affidavit in Court today in paragraph 3 whereof it has been stated as follows:-

“3. That the communication made by the Registrar to the College since was based on without proper verification and as well as non-application of mind, the College clarified the matter indicating that the College has Ac.2.003 dec. of land with undisputed ownership and possession of the said land, therefore, the syndicate in its meeting held on 05.11.2005 took the decision to grant permanent affiliation at 3 years Bachelors Degree Science Stage with Geology (Pass) with 16 seats to Stewart Science College,

Madhusudan Mark in the District of Cuttack from the Session 2005-06 and the decision of the syndicate was communicated to the Principal, Stewart Science College, Madhusudan Marg, Cuttack vide letter No. 64191 dated 212.11.2005 by the Registrar of the University vide order of the syndicate. A copy thereof is annexed herewith as Annexure-5.”

In view of the assertions made in pararagraph 3 of the affidavit filed on behalf of the petitioner, the relief sought in this writ application, has already been granted. Therefore, the writ application stands disposed of.
