Heard Mr. S. Mohanty, learned counsel for the petitioner.

The petitioner has filed this writ petition to revise the gradation list in Annexure-5 and place him above opposite parties no.4 to 16 in the gradation list published on 05.01.2012. He also seeks to quash the promotion order dated 22.09.2018 issued by opposite party no.2 under Annexure-8. He further seeks for direction to the opposite parties to grant him promotion to the higher grade with all consequential service and financial benefits.

Mr. S. Mohanty, learned counsel for the petitioner contended that the petitioner has filed representation in Annexure-7 dated 22.03.2018 and direction may be issued to disposed of the said representation.

In course of hearing, this court pointed out that the petitioner has already made representations on 08.02.2009, 06.11.2010, 31.01.2012, 12.10.2013, 27.08.2015 and 13.12.2017 which are available in representations in Annexure-7 at page-44 of the writ petition. It is contended that the petitioner stood in the same footing with that of the petitioner in W.P.(C) No.11104 of 2014 and this Court disposed of the said writ petition vide order dated 01.07.2014 directing the opposite parties to consider the representation. But the fact remains, if the petitioner made representation on 08.02.2009 successively till 13.12.2017 and has waited for more than 8 years and never approached this Court

ventilating his grievances, by adopting dilly dally tactics, the petitioner cannot approach this Court by filing this writ petition seeking for direction to consider his representation at belated stage.

However, in course of hearing, learned counsel for the petitioner states that the petitioner may be permitted to withdraw the writ petition with liberty to approach the appropriate forum.

In view of the above, the writ petition is disposed of as withdrawn granting liberty as aforesaid.
