Learned counsel for the appellant/ petitioner in both the cases has filed memo indicting therein that this Court has directed the appellant/ petitioner to produce the documents relating to monthly payment to the respondent/ opposite party in pursuance of the direction given vide order dated 17.02.2010 passed by the learned Judge, Family Court, Rourkela in Misc. Case No.21 of 2009 arising out of C.P. No.258 of 2008.
Learned counsel for the appellant/ petitioner submits that he had issued registered letter to the appellant/ petitioner. But, the same has returned back with an endorsement of the Postal Department that the appellant/ petitioner addressee has left the quarter. Therefore, the letter was returned to the sender i.e. the Advocate for the appellant/ petitioner. Learned counsel for the appellant/ petitioner further submits that as he could not receive any information from the appellant/ petitioner, appropriate order may be passed.
In that view of the matter, since the appellant/ petitioner is not forthcoming the Court, both the aforesaid MATA and the writ petition are dismissed for non-prosecution.
